EPSA Promotion Terms and Conditions

These terms and conditions are issued by Energy Power Systems Australia Pty Ltd ABN 80 055 274 514 (referred to as EPSA, We, Us or Our). 

These terms apply to all competitions, give-aways and promotions which we announce or advertise via our Website www.energypower.com.au, via e-mail, via newsletters and or using social media, for example on:

Sometimes extra terms and conditions will apply to a competition or give-away that we run. When they do we will make this clear in the promotion, give-away and/or competition.

1           METHOD OF ENTRY

  • To enter the promotion entrants must follow the instructions provided in the competition announcement on the online platform the promotion is held. 
  • Where the promotion is a “purchase to win” promotion entrants must purchase the advertised Cat® product under sale terms and conditions agreed by Us during the advertised promotion period.
  • For competitions/giveaways through which entrants must answer a specific question, unless otherwise stated in the premise: a winning entry/entries will be drawn at random; the first entry/entries drawn containing the correct answer will win.
  • For competitions/giveaways through which entrants must provide a response, unless otherwise stated in the premise: a winning entry/entries will be chosen by a panel representing EPSA based on creativity, originality and adherence to the brief, at the discretion of EPSA.


The promotion duration is as indicated in the promotion announcement via the online platform the promotion is held.


The nature and value of the prize is as indicated in the promotion announcement via the online platform the promotion is held.  For voucher give‐aways, vouchers are not redeemable for cash.  Unless stated otherwise, all prize values are the recommended retail value in Australian dollars and are correct at time of printing. EPSA takes no responsibility for variations in the prize value.

4           ELIGIBILITY

  • Entry to promotion events is usually restricted to existing and new customers of EPSA who purchase EPSA Cat® products during the advertised promotion period as stated in the promotion advertisement. 
  • Participants must be Australian residents and be 18 years of age or over to enter. 
  • Entry is open to all residents in Australia who fulfil the entry requirements. 
  • Employees, directors, management of EPSA, its related companies and agents associated with the promotion, the immediate families of the above listed persons are ineligible to enter.


  • Winners will be drawn at random from all valid entries received during the promotional period. The draw will take place at EPSA at the time designated in the promotion announcement.
  • All competitions/giveaways for which entrants must provide an original response or submission will be judged based on creativity, originality and adherence to the brief.


Prize winner will be notified via the online platform the competition is held or by direct email or telephone to the email address or telephone number they have provided to EPSA.

  • Prizes / give aways are subject to availability, non‐transferable and not exchangeable, and must be used on the dates specified by EPSA.
  • Where the prize is tickets or vouchers winners are responsible for redeeming the prize on or by the date(s) specified.  EPSA will not be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided. EPSA may, subject to State regulations, substitute a different prize of equivalent value in place of any prize referred to in these terms and conditions.
  • The prize does not include any other costs of a personal nature not stated. This prize must be taken as stated and no compensation will be payable if the recipient is unable to use it as stated.
  • Delivery of the prize / give-away will be by the mode of delivery specified in the promotion advertisement and, if none, specified will be by Australia Post to postal details provided by the winner.


  • It is a condition of entry that EPSA has the right to publicise, broadcast and communicate to the public the names, characters, likeness and voice of any entrants for any promotion or matter incidental to the promotion.
  • Entrants may be required by EPSA to participate in any photo, recording, video and/or film session(s) (the “publicity materials”) and acknowledge that EPSA has the right to use such publicity materials in any medium (including the internet) and in any reasonable manner it sees fit, unless that person advises EPSA at the time of entering the promotion that he/she wishes to retain his/her anonymity.
  • By entering any EPSA promotion and/or give‐away, the entrant warrants that the submission (and any part thereof) is their own work, or that they have any permissions necessary from the owner of the material to reproduce and distribute the work, and gives permission for EPSA to publish this content through its social media, website and E‐Newsletter.


To the extent permitted by law, all entrants release from, and indemnify EPSA against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the promotion including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.


All decisions and actions of EPSA relating to the promotion and/or redemption of the prizes are exercised at its absolute discretion and are final. No discussions or correspondence with entrants or any other person will be entered into.

EPSA accepts no responsibility for any incorrectly submitted, incomplete, late, lost or misdirected entries or for any technical malfunction of any communications network.
